In der vorliegenden Arbeit wird eine normative Analyse und Verteidigung der Erbschaftssteuer unternommen. Zunächst wird eine egalitaristische Argumentation für die Steuer entfaltet. Aufgrund ihrer progressiven Struktur ist die Erbschaftssteuer ein geeignetes Instrument, um der wachsenden ökonomischen Ungleichheit entgegenzuwirken und letztlich verschiedene egalitäre Ideale (politische Gleichheit, Chancengleicheit etc.) zu befördern. Anschließend wird untersucht, wie aus normativer Perspektive zu beurteilen ist, dass der Erblasser bei Erhebung der Steuer nicht mehr lebt. Die restliche Arbeit besteht in einer Auseinandersetzung mit den wichtigsten Einwänden gegen die Erbschaftssteuer. So wird oft behauptet, diese verletze die natürlichen Eigentumsrechte des Erblassers bzw. des Erben und sie ignoriere zudem die Verdienstansprüche des Erblassers. Schließlich sei die Steuer aus diversen "familien-basierten" Erwägungen abzulehnen. Nicht nur werden diese Einwände erfolgreich zurückgewiesen; ferner wird gezeigt, dass einige der, diesen Argumenten zugrundeliegenden, Prinzipien selbst zur Verteidigung einer egalitären Erbschaftssteuer (also einer Erbschaftssteuer, die aus egalitären Prinzipien folgt) herangezogen werden können.

Politische Akteure rekurrieren zur Rechtfertigung ihres Handelns wieder verstarkt auf die Idee des allgemeinen Wohls. Kann die politische Philosophie eine Bestimmung des Gemeinwohls anbieten, anhand derer sich gerechtfertigte von ungerechtfertigten Gemeinwohlrekursen unterscheiden lassen? Das Paradigma des Prozeduralismus besagt, dass das Gemeinwohl allein uber die Angabe formaler Verfahrenskriterien als Output eines wohlgeordneten demokratischen Systems definiert werden kann. Der Autor weist dieses Paradigma zuruck und optiert fur eine integrative Gemeinwohltheorie. Diese besteht aus zwei Komponenten. Erstere besagt, dass die Mitglieder eines Gemeinwesens durch demokratische Verfahren, die der Umsetzung ihrer subjektiven Interessen dienen, selbst festlegen konnen, worin das Gemeinwohl besteht - es sei denn, sie verstoen damit gegen objektive und prozedurtranszendente Mindeststandards. Die zweite Komponente besteht aus einem Katalog dieser Standards, die festlegen, welche Outputs entgegen dem Fur-Gut-Halten der Mitglieder gemeinwohlschadlich oder -irrelevant sind. Somit ergibt sich die Gemeinwohldienlichkeit einer Handlung daraus, dass diese demokratisch autorisiert ist und objektiv-prozedurtranszendente Mindeststandards nicht verletzt.

Demokratische Territorialstaaten besitzen die Souveränität, über die Verteilung ihrer Mitgliedschaftsrechte unilateral zu entscheiden. Damit werden jedoch nicht nur ihre Mitglieder, sondern auch alle Nicht-Mitglieder durch demokratisch verabschiedete Mitgliedschaftsnormen adressiert. Diese Untersuchung erörtert, ob unilaterale Einwanderungsbeschränkungen ein Demokratiedefizit darstellen und argumentiert dafür, dass dies zutrifft, sofern demokratische Territorialstaaten entweder faktische Mitglieder mit sozialen oder ortsabhängigen Bindungen zu dem politischen Kollektiv oder geographischen Territorium exkludieren oder aber eine egalitaristische Verteilungsstruktur territorialer Rechte verletzen. Hierdurch versucht diese Arbeit, einen Beitrag zu leisten, demokratietheoretische und territorialrechtliche Ansätze miteinander zu verknüpfen und nicht nur die politischen, sondern auch territorialrechtlichen Externalitäten staatlicher Ausschlussrechte in einer globalisierten Welt zu reflektieren.

In diesem Buch wird die Frage untersucht, inwiefern es einen Konflikt gibt zwischen zwei Sichtweisen auf Personen, die uns beide vertraut sind. Zum einen sind wir der Auffassung, dass Personen aus Grunden urteilen und handeln, dass ihre Handlungen und Meinungen durch Prozesse zustande kommen, die sowohl in ihrem Verlauf als auch ihrem Resultat bestimmten normativen Standards unterliegen, fur deren Einhaltung oder Nicht-Einhaltung Personen oft auch verantwortlich gemacht werden. Zum anderen versuchen wir manchmal, ihre Meinungen und Handlungen genauso wie andere Phanomene zu erklaren und suchen dabei nach zeitlich vorhergehenden Faktoren als Ursachen. Eine vollstandige Erklarung wurde dabei die Meinung oder Handlung des Subjekts als durch diese Ursachen alternativlos festgelegt und damit als determiniert erweisen. Zwischen diesen beiden Sichtweisen kann man aus verschiedenen Grunden und in verschiedenen Hinsichten einen manifesten Konflikt oder zumindest eine Spannung erblicken. Diese Konfliktfelder, in denen sich jeweils kompatibilistische und inkompatibilistische Argumente und Positionen gegenuber stehen, bilden den Gegenstand der vorliegenden Untersuchung.

Eine moralische Praxis kann man mit ihrer Vorteilhaftigkeit begrunden, ohne Moral und Vorteil gleichzusetzen. Um diese These zu untermauern, zeigt der Autor zunachst, wie eine interessenbasierte Vertragstheorie Grunde fur die Akzeptanz moralischer Normen liefert. Er widmet sich dann dem Einwand, dieser Ansatz reduziere Moral auf Eigeninteresse und habe ein falsches Bild des moralischen Uberlegens. Derartige Kritik beruht, so der Autor, auf einem Missverstandnis, das entsteht, wenn man Rechtfertigung und Analyse der Moral nicht streng trennt: Eine interessenbasierte Moralbegrundung ist namlich keine Theorie uber die Natur moralischer Normen oder uber die Bedeutung moralischer Urteile. Wie sollte man moralische Urteile und Normen dann analysieren? Der Autor argumentiert, dass eine anti-realistische Metaethik am besten geeignet ist, um als Hintergrundtheorie der interessenbasierten Begrundung Semantik und Metaphysik der Moral zu erklaren. Die Rede von Koharenz ist in der Ethik popular. Insbesondere wenn es um die Rechtfertigung von Moralurteilen geht, verweisen viele Autoren auf einen Koharenzbegriff. Dabei wird jedoch nur selten die Frage gestellt, was unter Koharenz genau zu verstehen ist. Dieser Frage ist dieses Buch gewidmet. Der Autor zeigt, dass es den einen Koharenzbegriff in der Ethik nicht gibt. Vielmehr lassen sich hier mindestens vier verschiedene Koharenzbegriffe unterscheiden. Die Semantik dieser vier Koharenzbegriffe wird in diesem Buch eingehend analysiert. Es wird untersucht, unter welchen metaethischen Vorannahmen diese Begriffe in eine Koharenztheorie fur die Ethik eingebettet werden konnen. Dabei zeigt sich, dass den unterschiedlichen Begriffen verschiedene Koharenztheorien korrespondieren. Diese Koharenztheorien sind inhaltlich heterogen und gehen von divergierenden, untereinander inkompatiblen metaethischen Vorannahmen aus. Deshalb ist es nicht moglich, die konkurrierenden Ansatze in eine einzige, umfassende Koharenztheorie fur die Ethik zu integrieren. Dieses Buch macht darauf aufmerksam, dass die Rede von Koharenz in den Fachdebatten notorisch unklar bleibt. Der Autor arbeitet dieses Defizit auf und bietet so eine solide Grundlage fur die weitere Auseinandersetzung mit dem Thema Koharenz in der Ethik.
