Es ist anzumerken, dass die kongolesische Diplomatie in der hochsensiblen Zone der konzentrischen Kreise in Zentralafrika keine positiven Auswirkungen auf den diplomatischen Schutz der Kongolesen im Ausland hatte und sich nicht effektiv am diplomatischen Schutz ihrer Staatsangehörigen beteiligte, die in unmenschlicher Weise aus der Republik Kongo und Angola vertrieben wurden. Die Außenpolitik der Dritten Republik hatte keine effektive Leitideologie, um alle Faktoren, über die die DR Kongo verfügt, umzuwandeln und ihre Außenpolitik sehr effizient zu gestalten. Die DRK hat trotz der Übergriffe, Vergewaltigungen und Verbrechen gegen die Menschlichkeit diplomatische Lösungen bevorzugt und das Prinzip der guten Nachbarschaft hochgehalten. Die Fälle wurden bislang auf der Ebene der großen gemischten Kommissionen zwischen der DRK und ihren beiden Nachbarn vor sich hergeschoben. Bei den zuständigen Gerichten für die Verteidigung der Menschenrechte wurden keine Beschwerden eingereicht. Wir haben die Vereinten Nationen aufgefordert, über den EuGH und den IStGH einzugreifen, um die kongolesischen Opfer zu untersuchen, zu bestrafen und ihnen ihre Rechte wiederzugeben. Wir glauben, dass die aus der Republik Kongo und Angola vertriebenen Kongolesen international diskriminiert werden.

Vale a pena notar que a diplomacia congolesa na zona altamente sensível dos círculos concêntricos da África Central não teve um impacto positivo na protecção diplomática dos congoleses no estrangeiro e não esteve efectivamente envolvida na protecção diplomática dos seus nacionais expulsos de forma desumana da República do Congo e de Angola. A RDC tem preferido resolver as suas disputas através dos canais diplomáticos, defendendo o princípio da boa vizinhança, apesar das exacções, violações e crimes contra a humanidade. Os casos continuam a arrastar-se ao nível das grandes comissões conjuntas entre a RDC e os seus dois vizinhos. Nenhuma queixa foi apresentada nas jurisdições competentes em matéria de direitos humanos. Apelámos à intervenção da ONU através do TJCE e do TPI para examinar, sancionar e restaurar os direitos da vítima congolesa. Se acreditarmos que os congoleses expulsos da República do Congo e de Angola irão sofrer discriminação internacional.

Vale la pena notare che la diplomazia congolese nella zona altamente sensibile dei cerchi concentrici dell'Africa centrale non ha avuto un impatto positivo nella protezione diplomatica dei congolesi all'estero e non è stata effettivamente coinvolta nella protezione diplomatica dei suoi cittadini espulsi in modo disumano dalla Repubblica del Congo e dall'Angola. La RDC ha preferito risolvere le controversie attraverso i canali diplomatici, sostenendo il principio del buon vicinato, nonostante le esazioni, gli stupri e i crimini contro l'umanità. I casi si trascinano ancora a livello di grandi commissioni miste tra la RDC e i suoi due vicini. Non è stato presentato alcun reclamo presso i tribunali competenti in materia di diritti umani. Abbiamo chiesto l'intervento delle Nazioni Unite attraverso la Corte di giustizia europea e la Corte penale internazionale per esaminare, sanzionare e ripristinare i diritti delle vittime congolesi. Se crediamo che i congolesi espulsi dalla Repubblica del Congo e dall'Angola subiranno una discriminazione internazionale.

Die größte Originalität dieses Buches liegt in der vertraglichen Verpflichtung, die der Autor sowohl bei den Produktionsinstrumenten als auch bei der Analyse der Felddaten eingegangen ist, ohne dabei einen epistemologischen und erbaulichen Beitrag zu vergessen. Auf theoretischer Ebene behandelt das Werk das Thema, das für das kongolesische Volk zweifellos von großem Interesse ist; es berührt die Krise, die das Land während der vorherigen Legislaturperiode (2006-2011) erlebt hat, und die Krise nach den Wahlen vom 28. November 2011, die in einem sehr speziellen Kontext stattgefunden hat und von mehreren Bedenken umgeben war. Da die Funktionsweise der Institutionen von nicht zu unterschätzender Bedeutung ist, sollten die politischen Spielregeln, die die Legitimitätskonflikte in unserem Land beeinflussen und für die das kongolesische Volk so sehr gelitten hat, seziert werden. Auf wissenschaftlicher Ebene war es unser Anliegen, den ursprünglichen Willen des Verfassungsgebers in Bezug auf die Funktionsweise der Institutionen der Demokratischen Republik Kongo-Kinshasa, wie sie in der Verfassung vom 18. Februar 2006 definiert sind, zu verstehen.

The greatest originality of this book is based on the effort of contractualisation made by the author both in terms of production tools and analysis of field data, without forgetting an epistemological and edifying contribution. This book addresses on the theoretical level, the subject under review is undoubtedly of great interest to the Congolese people; it touches the crisis that the country has gone through during the past legislature (2006-2011), and the post-electoral crisis of the elections of November 28, 2011, organized in a very particular context and surrounded by several concerns. Given that the functioning of institutions is of considerable importance, it is appropriate to dissect the rules of the political game that influence the conflicts of legitimacy in our country and for which the Congolese people have suffered so much. From a scientific point of view, it was our concern to understand the primary will of the constituent in the way the institutions of the Democratic Republic of Congo-Kinshasa should function, as established by the constitution of 18 February 2006.

A maior originalidade deste livro baseia-se no esforço de contratualização feito pelo autor tanto em termos de instrumentos de produção como de análise de dados de campo, sem esquecer uma contribuição epistemológica e edificante. Este livro aborda a nível teórico, o tema em análise é sem dúvida de grande interesse para o povo congolês; toca a crise que o país atravessou durante a legislatura passada (2006-2011), e a crise pós-eleitoral das eleições de 28 de Novembro de 2011, organizada num contexto muito particular e rodeada de várias preocupações. Dado que o funcionamento das instituições é de considerável importância, é conveniente dissecar as regras do jogo político que influenciam os conflitos de legitimidade no nosso país e pelos quais o povo congolês tanto tem sofrido. De um ponto de vista científico, foi nossa preocupação compreender a vontade primária do constituinte na forma como as instituições da República Democrática do Congo-Kinshasa deveriam funcionar, tal como estabelecido pela Constituição de 18 de Fevereiro de 2006.

La maggiore originalità di questo libro si basa sullo sforzo di contrattualizzazione compiuto dall'autore sia in termini di strumenti di produzione che di analisi dei dati sul campo, senza dimenticare un contributo epistemologico ed edificante. Questo libro affronta sul piano teorico un tema che è indubbiamente di grande interesse per il popolo congolese; tocca la crisi che il Paese ha attraversato durante la passata legislatura (2006-2011), e la crisi post-elettorale delle elezioni del 28 novembre 2011, organizzata in un contesto molto particolare e circondata da diverse preoccupazioni. Poiché il funzionamento delle istituzioni è di notevole importanza, è opportuno sviscerare le regole del gioco politico che influenzano i conflitti di legittimità nel nostro Paese e per i quali il popolo congolese ha tanto sofferto. Da un punto di vista scientifico, ci siamo preoccupati di comprendere la volontà primaria del costituente nel modo in cui dovrebbero funzionare le istituzioni della Repubblica Democratica del Congo-Kinshasa, come stabilito dalla Costituzione del 18 febbraio 2006.
