Inhaltsangabe:Einleitung: Das Treffen von Entscheidungen in allen Unternehmensbereichen (bei der Beschaffung, Distribution, Finanzierung etc.) kennzeichnet die Tätigkeit und den Erfolg einer Führungskraft. Gerade in Dienstleistungsbetrieben stellen jedoch auch die Mitarbeiter einen entscheidenden Faktor zum Unternehmenserfolg dar; dementsprechende Bedeutung besitzen Personalentscheidungen. Gemäß dem Thema dieser Arbeit soll analysiert werden, welche Kompetenzen die Führungskräfte öffentlicher Unternehmen diesbezüglich in Personalentscheidungen besitzen. Welche rechtlichen Einschränkungen durch Gesetz, Satzung o.ä. existieren, die Führungskräfte der oberen Ebene bei o.a. Entscheidungen zu beachten haben? Welche Unternehmensorgane besitzen Mitsprache- oder Mitentscheidungsrechte, verliehen aufgrund gesetzlicher Normen oder durch Satzung bzw. Träger? Welche sonstigen Einflußgrößen wirken auf die Personalentscheidungen ein? Wie sind die Kompetenzeinschränkungen hier im Zusammenhang mit anderen, wohl auch problematischen Zuständigkeitsbeschneidungen auf weiteren Gebieten zu sehen? Handeln womöglich die Führungskräfte öffentlicher Unternehmen als Ausführungsorgane des Trägers? Gang der Untersuchung: Das erste Kapitel der Arbeit widmet sich den rechtlichen Rahmenbedingungen dieser Fragestellung. Gegliedert nach den üblichen Rechtsformen öffentlicher Unternehmen wird erläutert, wie die Kompetenzen aufgrund von Gesetzen und Verordnungen zwischen Trägern und den Unternehmensorganen verteilt sind. Vom gesetzlichen Regelfall weicht die Praxis oftmals ab. Dies beruht auf modifizierenden Bestimmungen der Satzung oder auf weniger verbindlichen Geschäftsordnungen bzw. stillschweigend gültigen Routinen. Im zweiten Kapitel wird über die im Rhein-Neckar-Kreis durchgeführte Befragung in sechs öffentlichen Unternehmen berichtet. Für diese Befragung wurde jeweils ein Unternehmen als exemplarisch für die im ersten Kapitel erläuterten Rechtsformen ausgewählt. Die Interviewpartner waren Geschäftsführer, Betriebsleiter bzw. Abteilungsleiter. Das dritte Kapitel ist den Einflußgrößen personalwirtschaftlichen Handelns in öffentlichen Unternehmen gewidmet. Zunächst werden diese Einflußgrößen allgemein beschrieben unter bezug auf die einschlägige Literatur. Sodann werden die Einflußgrößen thematisiert, die bei den Interviewgesprächen angetroffen wurden.
