"Aus allem bisher Gesagten kann man einen allgemeinen sehr nützlichen Lehrsatz ableiten, der mit dem Herkommen, das doch der gewöhnliche Gesetzgeber der Nation ist, wenig im Einklang steht: damit die Strafe nicht eine Gewalttat eines oder vieler gegen einen einzelnen Bürger sei, muß sie durchaus öffentlich, schnell eintretend, notwendig, so milde wie es die obwaltenden Umstände irgend gestatten, den Verbrechen angemessen und durch das Gesetz bestimmt sein."Cesare Beccaria war ein bedeutender italienischer Rechtsphilosoph und Strafrechtsreformer im Zeitalter der Aufklärung. Aufgrund seines Werkes ¿Dei delitti e delle pene" (deutsch: ¿Von den Verbrechen und von den Strafen") gilt dieser Aufklärer zudem als Begründer der ¿Klassischen Schule der Kriminologie". In diesem, vom Gedankengut der Aufklärung und der utilitaristischen Ethik geprägten Werk vertrat er die These, dass der Staat nur das Maß an Strafen verhängen solle, welches zur Aufrechterhaltung der Ordnung erforderlich ist. Bei der Strafzumessung sei der Grundsatz der Verhältnismäßigkeit zu beachten. Nicht die Schwere der Strafe sei entscheidend, sondern die konsequente Anwendung der Strafgesetze. Becarria's influential "Treatise On Crimes and Punishments" is considered a foundation work in the modern field of criminology. This book tells the three master themes of the Enlightenment run through the Treatise: the idea of the social contract, the idea of science, and the belief in progress.

Aonia edizioni. Dei delitti e delle pene è un breve saggio scritto dall'illuminista italiano Cesare Beccaria pubblicato nel 1764. È senz'altro il testo più noto dell'Illuminismo italiano se si considera la sua fortuna in Italia e in Europa e la sua influenza sui pensatori cronologicamente successivi. In questo breve trattato Beccaria si pone con spirito illuminista delle domande circa i delitti e le pene allora in uso. L'opera, stampata per la prima volta a Livorno da Marco Coltellini, incontrò un notevole successo ed ebbe vasta eco in tutta Europa. Fu apprezzata nella Milano illuminista, fu vista come il prodotto dell'attività innovatrice in Francia e messa subito in pratica dalla zarina Caterina II di Russia. L'opera fu scritta in francese, poiché in questo periodo era forte l'egemonia della Francia e le persone di cultura parlavano e scrivevano in francese con naturalezza, anche se di diversa nazionalità.
