La società camerunese è un crogiolo culturale di tradizione e modernità. La sua istituzione sociale, il matrimonio, ne è la prova per eccellenza. Infatti, il matrimonio, nei suoi effetti e conseguenze e prima di tutto nella sua formazione, che è l'oggetto del nostro studio, è influenzato da norme di diritto moderno tratte dal diritto francese e da norme di diritto tradizionale camerunese. A questo proposito, notiamo che queste ultime vengono spesso accantonate a favore delle prime, che godono di una certa supremazia. Tuttavia, il diritto applicabile a una determinata società deve rispecchiare perfettamente tale società. In questo senso, la nostra riflessione è un invito ai legislatori camerunesi a tenere maggiormente conto del diritto tradizionale. Quest'ultimo dovrebbe attingere maggiormente alle risorse giuridiche tradizionali per produrre un diritto che rifletta la realtà sociale del Camerun. Non si tratta quindi di perdersi nella moltitudine di pratiche consuetudinarie esistenti, ma di trarre da esse le regole essenziali del diritto, universali per tutti i gruppi etnici e rispettose della dignità della persona umana.

Die kamerunische Gesellschaft ist geprägt von einer kulturellen Mischung aus Traditionen und Moderne. Ihre soziale Institution, die Ehe, ist der beste Beweis dafür. Die Ehe wird in ihren Wirkungen und Folgen und vor allem in ihrer Entstehung, die Gegenstand unserer Studie ist, von modernen, aus dem französischen Recht abgeleiteten Rechtsregeln und von traditionellen kamerunischen Rechtsregeln beeinflusst. In diesem Zusammenhang fällt auf, dass letztere oftmals zugunsten der ersteren, die eine gewisse Vorherrschaft genießen, außer Acht gelassen werden. Das auf eine bestimmte Gesellschaft anwendbare Recht muss jedoch ein perfektes Spiegelbild dieser Gesellschaft sein. In diesem Zusammenhang sind unsere Überlegungen ein Aufruf zu einer besseren Berücksichtigung und tatsächlichen Berücksichtigung des traditionellen Rechts durch den kamerunischen Gesetzgeber. Letzterer sollte besser aus der traditionellen Rechtsressource schöpfen, um ein Recht zu schaffen, das die soziale Realität in Kamerun widerspiegelt. Es geht also nicht darum, sich in der Vielzahl der bestehenden Gewohnheitspraktiken zu verirren, sondern daraus die wesentlichen und universellen Rechtsregeln für alle ethnischen Gruppen abzuleiten, die die Würde der menschlichen Person respektieren.

Cameroonian society is a cultural melting pot of tradition and modernity. The social institution of marriage is a prime example of this. Indeed, the effects and consequences of marriage, and first and foremost its formation - the subject of our study - are influenced by modern legal rules drawn from French law and traditional Cameroonian law. In this respect, we note that the latter are often set aside in preference to the former, which enjoy a certain supremacy. And yet, the law applicable to a given society must be a perfect reflection of it. In this respect, our reflection is a call to Cameroonian legislators to take greater account of traditional law. The latter should draw more on traditional legal resources to produce a law that reflects Cameroon's social reality. It's not a question of getting lost in the multitude of existing customary practices, but of drawing from them the essential rules of law that are universal to all ethnic groups and respectful of human dignity.

No entanto, o direito aplicável a uma determinada sociedade deve ser um reflexo perfeito da mesma. Neste sentido, a nossa reflexão é um apelo aos legisladores camaroneses para que tenham mais em conta o direito tradicional. Este último deve apoiar-se mais nos recursos jurídicos tradicionais para produzir uma lei que reflicta a realidade social dos Camarões. Não se trata, portanto, de se perder na multiplicidade de práticas consuetudinárias existentes, mas de extrair delas as regras essenciais do direito que são universais a todos os grupos étnicos e que respeitam a dignidade da pessoa humana.
