Using Palestine as a case study, Recognition Politics in Settler Colonial States shows how recognition politics operate to legitimize long-standing colonial power structures. In existing scholarship, recognition has been seen as an asset coveted by indigenous communities. This book forwards a new, theoretically ground-breaking perspective. Emile Badarin shows that in colonial contexts, settlers use recognition to legitimize and normalize the dispossession and elimination of Indigenous people. More than this, settler-colonial states themselves actively pursue recognition, employing it as a means to further the elimination of the indigenous societies they seek to replace. In making the case, the book critically examines the Euromodern categories of race, racism and racial hierarchies and draws new conclusions about the interplay between colonialism, racism and Zionism. Central to this analysis is how anti-Zionism has been strategically equated with anti-Semitism, and effectively used as a tool for the advancement of both settler-colonialism in Palestine and Israel's recognition on the international stage. The book delves into indigenous normative resistance against colonial recognition politics through the lens of the Palestinian practice of ?umud (steadfastness), extracting its philosophy of liberation as a pathway towards a decolonial future for all in Palestine and beyond.

This book explores the complex landscape of costs and funding of civil justice.Access to civil justice continues to be undermined by State retrenchment of legal aid budgets, increases in procedural costs, the complexity of court procedures, and severe delays in the dispensation of justice. This has resulted in a shift from public to private funding of civil litigation, and the emergence of new business models and forms of private justice. The book explores the dynamic landscape of legal costs and financing from 3 perspectives: regulatory frameworks in public and private funding; new trends and challenges in contemporary legal financing; and the transformative potential of alternative dispute resolution (ADR) and online dispute resolution (ODR) procedures to streamline civil justice processes and expand access to justice.By addressing the intersectionality of legal, economic, political, market and social dynamics, the book helps readers gain a better understanding of the inherent complexity of costs, funding, and their implications for access to justice. This timely resource offers academics, policymakers, and practitioners valuable insights into the dynamics that shape the current state and future prospects of civil justice in Europe to help create sustainable pathways for improved access to justice.

Examining the archaeological material of the modern period, over a period of the last 500 years, this open access book presents a series of case studies that challenges the fallacy of Nordic egalitarianism. The widening gap between rich and poor Western countries is now a well-known phenomenon and while Scandinavia has often been hailed as one of the regions where inequality has been the lowest, even here a similar trend toward widening inequality has been observed. The topic of inequality has long been a major focus of interest within archaeology, but the goal and novelty of this volume is to start with the problem of material disparity by asking what this means, rather than starting with the problem of social inequality and trying to map observable material disparities onto its various conceptualizations. Key themes include variations between urban and rural contexts, as well as geographical proximity to centres of commerce and industry, different local/cultural valuations of - especially consumer - goods and discard practices. The result is an original study of a wealth of material culture that tells us how extensive this inequality actually was and the different ways it appeared in various societies. The ebook editions of this book are available open access under a CC BY-NC-ND 4.0 licence on bloomsburycollections.com. Michelle Keener incorporates advances in modern trauma theory in the interpretation of the book of Job.Keener focuses primarily on using the framework of a psychological trauma narrative to read the text, providing new insights into how Job functions as a text that deals with trauma. After an extensive introduction to the history and fundamentals of trauma theory Keener actively applies a trauma theory reading to the book of Job with special attention paid to the elements of a therapeutic trauma narrative, its role in the cognitive resolution of trauma, and how this is reflected in the biblical text. This approach provides alternative answers to some of the suggested redactions, reconstruction, and inconsistencies identified in the text of Job by previous scholars. Keener also draws in the Wesleylan Quadrilateral as a means of reading the texts, and examines how her conclusions may be useful in applied community contexts.

In this book, leading international building and private law experts provide a timely and unique analysis of the real-world problem of building safety, approached through the lens of private law.It explores the extent to which private law can be part of the solution to - as well as being part of the cause of - the building safety crisis which afflicts people around the world. The book offers policymakers, practitioners and scholars ground-breaking consideration of this vital yet under-considered aspect of the building safety crisis, along with new and valuable insights into the nature, limits and utility of private law.The book examines the 'symptoms' of the building safety problem (fire, moisture ingress, structural integrity and beyond) across the UK, USA, Australia, Singapore, New Zealand, Italy and Canada. It covers the broad spread of categories within the realm of private law, including torts (primarily negligence), contract, and land (real property) law. International experts provide a variety of different perspectives on the complex and rapidly evolving relationship between private law and the measures which policymakers are implementing in response to the building safety crisis. The book examines in detail existing legislative and judicial responses to the crisis, offering guidance as to how statutory regimes addressing the building safety problem (such as the Building Safety Act 2022) can best be understood and developed. The book results from a joint research project by the Faculty of Law at the University of Oxford and Melbourne Law School at the University of Melbourne.

This book critically examines the theoretical foundations and legal framework for macroprudential policy, its tools and governance in the UK, the US, and the EU. It goes deeper into a normative discussion of the legitimacy of macroprudential policy in these jurisdictions, where the mandate for maintaining financial stability has been delegated to independent authorities. The Global Financial Crisis of 2007-2008 reopened debates regarding legitimacy of the independent regulatory state, given its democratic deficit. The response to a perceived legitimacy gap has been to increase political oversight in financial policymaking and regulation. The book posits that the real problem is not a lack of democracy, but rather a lack of social justice. Across the globe, there is growing dissatisfaction with a financial system and regulatory process that appear depersonalised and perpetuate inequalities. Citizens are calling for more socially just systems of governance and the future success of financial policymakers and regulators will hinge on this. Given the marked distributional effects that have been noted in some macroprudential policy tools, the book questions whether macroprudential policy should be solely based on highly rationalised and strongly quantitative reasons.By proposing that macroprudential policymakers should have a social justice mandate alongside their financial stability mandate, as well as legal mechanisms for operationalising the added authority, the book contributes to the growing discourse on the role of social justice in public policy.

This book develops a new theory of territorialism and international legal status of territories. It (i) defines the concept of territory, explaining how territories are created; (ii) redefines the concept of statehood, illustrating that statehood (rather than the statehood criteria) is territorial legal status established in the formal sources of international law; and (iii) grounds non-state territorial entities in the sources of international law to explain their international legal status. This fresh new theoretical perspective has both scholarly and practical importance, providing a tool helping decision-makers and judges in the practical application of international law both internationally and domestically.

This book analyses the history of the common law foundations of consumer law, and encourages readers to rethink the role that consumer law plays in our society. Consumer law is often constructed as purely statute-based law. However - as this collection will demonstrate - this is far from the truth. Much of the history of the common law concerns consumer transactions and markets. Case law has often established or modified the ground rules of consumer markets, has had a patterning effect on the economic organisation of markets, and has expressed cultural visions of the market and consumers. An analysis of landmark cases of consumer law allows many traditional cases to be viewed through a new and distinct lens, providing significant academic and intellectual value. The collection also includes a unique socio-legal perspective, considering the role that consumer law has played in addressing racial discrimination, LGBTQ challenges and the rights of women. This collection of landmark cases demonstrates the theoretical and practical significance of consumer law through a wide range of contributions by distinguished authors from the United Kingdom, Europe, the United States and Australia.

Material culture is the physical trace of what was used to construct and define identities in the past, and is therefore a key source of evidence for archaeologists and ancient historians investigating ancient identities. The focus of this volume is reflective of broader theoretical and methodological shifts in recent cross-disciplinary explorations of identity. Through the use of case studies, each chapter demonstrates the benefits and crucial need to embrace inter- and multi-disciplinary approaches when investigating life and society in ancient Greece. In particular, this book covers the ever-increasing spectrum of identities across the ancient Greek world, ranging from collective groups, such as women, migrants, children and slaves, to individual figures.Using archaeological, iconographic and textual material as the basis of each exploration, the contributors seek to understand the intersectional nature of what it meant to be an individual or group within a recognised social identity in ancient Greece. More specifically, this involves the analysis of various types of material culture such as artefacts from burials, excavated settlements, figurines, statuary, painted pottery, small finds and monuments. The contributors study the material using geo-spatial and architectural methods, along with more traditional approaches, such as epigraphy. Among other conclusions, the chapters investigate the experiences of identity - what the experience of having a particular identity was like, as far as we can ascertain - in ancient Greece, as represented by the archaeological material record.

The concept of the subject remains one of the most important and debated notions in social theory and philosophy. Whether it is adopted as a central notion of personhood or rejected as a product of ideology or fiction, its usage has been a theme in a variety of political and speculative thought. Unfortunately, the prevalence of the term has often rendered its meaning opaque. Being Subjects examines the history of this notion from Descartes to the present and discusses its emergence as a philosophical category as well as its connection to related notions such as essence and being. Drawing from the tradition of Fanon's revolutionary existentialism and a historical materialist approach to thought, J. Moufawad-Paul argues that despite the rejection of the subject by thinkers such as Althusser and Foucault, thinking the subject remains a meaningful philosophical practice for a politics dedicated to radical social transformation. If we can think through the category of the subject, we can also think through the legacy of modernity which includes settler-colonialism, slavery, and capitalism. We can also think through a conception of transformative subjectivity and the path to a new personhood and collective agency beyond this legacy's weight of dead generations.

Drawing on qualitative research exploring the techniques of playwriting instructors, this book outlines signature pedagogies within playwriting instruction for 'novice' writers and how they may be reimagined and reinvigorated. Through research gathered in interviews with 11 instructors, and surveying their methods, syllabi and handouts, Andrew Black interrogates key challenges within dramatic writing pedagogy: the myth that it, along with creativity, cannot be taught; the lack of clarity about the instructional value of playwriting education for diverse contemporary audiences; the tendency to allow the writing product to drive instruction rather than process; and the tension between traditional and experimental models of play construction and how this can confound instructional techniques.Identifying 3 indispensable and signature pedagogies that are consistently used in the classroom - the writing exercise, the use of mentor texts and the workshopping of student material, this book describes key strategies and practices used by seasoned instructors which bring these pedagogical strategies to life, strategies which can support instructors in reimagining their playwriting classrooms. An intervention for "lorebased" pedagogical models that are often out of date and reflect the biases of previous generations, Black offers a starting point for instructors developing their first lesson plans that are inclusive and which offers a comprehensive understanding of the options available for them to use with their students.
