Om CULTURE AND EDUCATION IN HUMAN RIGHTS AND I.I.R.H.
Article 13 of the National Constitution recognizes the right to equality and non-discrimination as a fundamental right. Likewise, it admits the existence of groups historically discriminated against and in a high degree of vulnerability, assigning to the State the obligation to guarantee material equality through special measures in favor of these groups. Discrimination is a crime that seriously affects the Human Rights of individuals, it is closely linked to inequality and social injustice in such a way that it prevents access to goods and services in the quantity and quality required to satisfy their specific needs given their condition of vulnerability. In this order of ideas, it is necessary to apply the differential approach to the actions of the State in order to guarantee real and effective equality. For this purpose to become a reality, the cooperation of all public servants is necessary. The recognition of the quality of actors as guarantors of the right to equality and the guarantee of non-discrimination in public administration is fundamental for the development of fairer societies.
